Basic Legalities in the Business World

One of the must-knows in starting and doing business are the legalities in running a business.  The legal aspect plays an essential role in the entire business-making process because aside from the fact that there are certain laws need to be followed in running businesses, it should be taken into consideration that each business has a social responsibility. And these laws are the primary “pushers” for these businessmen to be conscious on their social responsibilities. 

This article focuses on the legalities of business tax and other tax advantages.    

First and foremost, it is very important that a business has a business permit.  Such permit is needed in order for the business to be legal. In other words, it can function and run without hitches-and-glitches if it works in the line of law. There are some businesses that exist without business permits; hence, it runs underground.  The process in acquiring business permits depend on the laws imposed by the state or the ordinances of a specific area.    

Another important aspect to be considered in running a business is the business tax.  Business tax rate depends on the business structure one has – there are the sole proprietorship, corporation, and Limited Liability Company. In a sole proprietorship, the business tax reflects on the sole owner’s income tax return.  This is so because the sole proprietor and the owner is just one person. Accordingly, the sole proprietorship is the most basic and easiest form of business structure. In the corporation structure, the taxes are “confined” within the corporation and not to the individuals that form the business (or in this case, the corporation).  In the corporation structure, the stakeholders have no personal liabilities in the business as a whole.  In another business structure, the limited liability company structure makes the owners choose whether to be fined with taxes either as a corporation, a sole proprietor or as in partnership.
